US Work Visas for Unskilled Workers

Unskilled workers considering the H-2A or H-2B visas should be aware of the temporary nature of the work, the potential for seasonal unemployment, and the need to return to their home country once the employment period ends.

While FrogHire.ai has largely focused on skilled worker job posts, we have fielded some questions in our biweekly seminars about options for those who are at a different station in life. Yes, there are U.S. work visas available for unskilled workers, and the ones we will address here are the two temporary work visas. These visas are designed for non-agricultural and agricultural labor where specialized skills or advanced education are not required.

The common visas in this category are the H-2A and H-2B visas.

H-2A Visa: Temporary Agricultural Workers

The H-2A visa allows U.S. employers to bring foreign nationals to the United States to fill temporary or seasonal agricultural jobs. This visa is specifically for work that is temporary in nature, such as planting, cultivating, or harvesting crops.

Key Features:

  • Temporary or Seasonal Work: The job must be for a temporary or seasonal need (no longer than one year).
  • Employer Requirements: The U.S. employer must demonstrate that there are not enough U.S. workers who are able, willing, qualified, and available to do the temporary work, and that employing H-2A workers will not adversely affect the wages and working conditions of similarly employed U.S. workers. This is very similar to all other non-domestic worker visas, where employers must guarantee that they are not displacing U.S. workers.
  • Worker Protections: The H-2A program has stringent worker protection requirements, including providing housing, meals, or kitchen facilities, and ensuring that workers receive at least the minimum wage.

H-2B Visa: Temporary Non-Agricultural Workers

The H-2B visa is for non-agricultural workers in jobs that are temporary, seasonal, peak load, or intermittent in nature. This visa covers a wide range of industries such as hospitality, construction, landscaping, and seafood processing.

Key Features:

  • Temporary or Seasonal Employment: Similar to the H-2A visa, the H-2B visa is meant for jobs that are temporary. The employer must establish that the need for the worker is temporary and will last no more than one year.
  • Cap Limit: The H-2B visa is subject to an annual cap of 66,000 visas, with 33,000 available for workers who begin employment in the first half of the fiscal year (October 1 - March 31) and 33,000 for those starting in the second half (April 1 - September 30). In some cases, additional visas may be made available by Congress.
  • Recruitment: Employers must recruit U.S. workers before hiring H-2B workers, similar to the requirements for the H-2A visa, and must demonstrate that hiring foreign workers will not adversely affect the wages and working conditions of U.S. workers.

Challenges and Considerations

While these visas provide a pathway for unskilled workers to gain employment in the U.S., employers must navigate a complex application process, and workers are often dependent on the employer for visa sponsorship. Because these visas are temporary, they do not provide a direct path to permanent residency (Green Card) or citizenship.  This is unlike the H-1B visa.
