Eligibility and Application

  • Eligibility:
    • You must have completed at least one academic year in the U.S. on an F-1 visa.
    • The work must align with your major field of study.
    • You cannot have used more than 12 months of full-time Curricular Practical Training (CPT).
  • Application Process:
    • File Form I-765 (Application for Employment Authorization) with USCIS and pay the applicable fee.
    • Submit a completed Form I-20 from your Designated School Official (DSO) recommending OPT.

  • Authorization Timeline:

  • Unemployment Limits:
    • You cannot be unemployed for more than 90 cumulative days during the OPT period.

Practical Considerations

  • Job Search:
    • Start early, as USCIS processing can take several months.
    • Keep detailed records of your job duties to prove the role aligns with your major.
  • Travel:
    • Traveling outside the US while your OPT application is pending or without a valid job offer can be a risky endeavor!

    • OPT workers are typically exempt from Social Security and Medicare taxes for their first five years in the US.
